is a complementary log-log conversion interval of the base risk rate, h 0 (t j). This means that the base hazard rate can vary at each interval, requiring only light parametric assumptions. Other scholars have relied on historical perspectives to explain the implementation of the treaty. For example, Curtis Bradley and Trevor Morrison proposed that the choice of presidents between the two engagement mechanisms be influenced, at least in part, by the Senate`s continued and concerted insistence on maintaining an important role in the ratification process. Footnote 45 Such insistence, which mainly results in statements and correspondence, would create a “soft law” that would impose political constraints on the options available to the executive. At the same time, the Attention of the Senate is selective, with an emphasis on “big” agreements, for which public engagement and attention are exceptionally high. Therefore, the differences in the application of the treaty would be explained, at least in part, by the fact that some agreements, particularly important arms control agreements, are subject to Senate scrutiny, while others are less of a concern to the Senate. The authors support their hypothesis anecdotally and recall cases where presidents have given up on major arms control agreements, such as the Treaty on Conventional Forces in Europe, under pressure from the Senate. While language implies that Congress approves the globe agreement, it is difficult to read an explicit authorization in the statute. In addition, the reproduced part of the act is the only time globe is mentioned and contains a total of 97 words. However, the entire legislation is more than 10,000 words long and was passed by a single roll-call vote in the House of Representatives and the Senate.
Footnote 111 Even if it were read as an ex-post authorization from GLOBE, the authorisation text would represent less than 1% of the total text of the law. Outside of trade, provisions like this, in which ex-post-congress executive agreements are supposed to be approved as a small part of a broader legislative package, are the rule, not the exception. Footnote 112 The result is an authorisation procedure that is remarkably different from the contract consultation and approval procedure. The latter focuses the total and indisputable attention of the Senate on the adoption of the agreement itself and does not directly link its success to the future of other political transpositions. Therefore, it is not certain that ex-post-congress executive agreements could consistently offer the same benefits as those granted by the treaty. As has already been said, empirical analyses can only provide an informative answer to this question when the ex-post executive agreement is observed more frequently and in a wider range of topics. 106 Alschner, Wolfgang, Seiermann, Julia – Skougarevskiy, Dmitriy, Text of Trade Agreements (ToTA)-A Structured Corpus for the Text as Data Analysis of Preferential Trade Agreements, 15 J.
